LCS FUNDED PROJECT NOTICE LCS 자금 프로젝트 입찰 주의 사항 Notice to Offerors Regarding Logistics Cost Sharing (LCS) Program 물류 비용 공유 프로그램 (LCS) 관련 투찰업체 공지 This solicitation is being conducted under the Logistics Cost Sharing (LCS) program and will result in a contract between the Government of the Republic of Korea (ROK) and the contractor. 이 입찰은 물류 비용 분담프로그램(LCS)에 따라 진행되고 있으며 대한민국 (한국) 정부와 계약자의 계약을 이끈다. ROK will directly pay the contractor. No appropriated funds of the United States (US) shall be obligated for payment due under this contract. 한국 정부가 직접 계약 지불 할 것이며 미국 (US) 정부의 어떤 충당 자금으로도 이 계약 건에 대해 지급할 의무가 없다. In accordance with the International Agreement between the United States and the Republic of Korea, titled “Amendment to the Implementing Agreement between the United States Forces Korea and the Republic of Korea Ministry of National Defense Concerning Logistics Cost Sharing” (hereinafter “International Agreement”), signed by the parties on 14 October 2015: 2015년 10월 14일에 각 당사자가 서명한 미국과 한국 사이의 국제 협정에 따라서 명명된 "물류 비용 공유 추진에 관한 주한 미군과 한국 정부 국방부 사이 체결된 아래 수정조항 " (이하 "국제 협약")에 의거하여 : "The parties hereby agree that all LCS work must be accomplished in the ROK or its territorial waters and that all equipment and supplies that are to be acquired with ROK Government funds shall be manufactured in the ROK, and all LCS service work shall be carried out by Korean contractor(s), the Korea Railroad Corporation, or the ROK military. "각 당사자는 모든 LCS 업무 수행이 한국 내 또는 한국영해 내에서 수행 할 수 있어야 함에 동의하고 대한민국 정부 자금으로 취득하는 모든 장비 및 공급 물품들은 한국에서 제조된 물품이어야 함에 동의한다. 또한 모든 LCS 서비스 작업을 한국 업체 (들), 한국 철도 공사, 또는 한국군에 의해서만 수행 할 수 있음에 동의한다. The term ‘Korean contractor(s)’ is defined as an entity, that, including its parent, is a domestic corporation under the Korean Tax Act and whose domestic status is recorded in the Certified Copy of Register or its successor document. A parent is defined as an entity that holds more than 50/100 of the total issued and outstanding shares in another company, as reflected in the Stock Change Certificate.” '한국 계약자 (들)'이란 용어는 모기업을 포함하여 업체로 정의되는데 한국 세법에 따르는 국내기업으로 국내에서의 상태가 등록 등본 또는 그 후속 문서에 기록 된 기업을 말한다. 모기업이란 주식 변경 인증서에 반영된 내용 상, 다른 회사의 총 발행 주식수의 100 분의 50 이상을 유지하는 기업으로 정의된다. " In order to establish eligibility for award under this LCS contract, the offeror shall submit the documents listed below with their proposal prior to the closing date/time established in the solicitation. The contracting officer will determine the offeror’s eligibility status as a Korean contractor solely on the basis of these documents. 이 LCS 계약 상의 수주 자격을 확립하기 위해서 투찰업체는 아래 나열된 문서를 제안서와 함께 입찰서상에 정해진 마감 날짜 / 시간 전에 제출하여야 한다. 계약관은 전적으로 이러한 문서를 기초로 하여 한국 업체로서의 자격 상태를 확인한다. 1. Prime Contractor Registration: The offeror shall submit its Certified Copy of Register (등기부 등본 (유효사항)), as certified and submitted to the ROK Supreme Court (대법원). In order to qualify as a Korean Contractor, the fourth block of the offeror's Certified Copy of Register [등기부 등본 (유효사항)] must state an address that is physically located in the Republic of Korea. 1. 원도급 계약자 등록증 : 입찰업체는 한국 대법원 (대법원)에서 발급하는 등본을 제출하여야 한다 (등기부 등본 (유효 사항)). 한국 계약자로 자격요건을 갖추기 위해서는 투찰 업체의 등본 상 네 번째 단 [등기부 등본 (유효 사항)]에서 반드시 물리적으로 대한민국에 위치한 주소 임을 명시해야 한다. 2. Prime Contractor Stock Change Certification: The offeror shall submit its most recent Stock Change Certificate (주식 변동 상황 명세서), as certified and submitted to the ROK Local Tax Office (국세청). The prime contractor’s Stock Change Certificate (주식 변동 상황 명세서) will be evaluated to determine if the prime contractor has a Parent (as defined in the International Agreement extract above). 2. 주 계약자 주식 변경 인증: 투찰업체는 국세청에서는 인증 발급하는 가장 최근의 주식 변경 증명서를 제출하여야 한다 (주식 변동 상황 명세서). 주 계약자의 주식 변경 증명서 (주식 변동 상황 명세서) 는 계약자가 모기업이 있는지 확인하기 위해 평가된다. ( 상기 국제 계약 협정 상 정의 된 대로) 3. If the Prime Contractor has a Parent, the offeror shall submit the Parent’s Certified Copy of Register (등기부등본 (유효사항)) as certified and submitted to the ROK Supreme Court (대법원). In order for the Prime Contractor to qualify as a Korean Contractor, the fourth block of the offeror’s Parent’s Certified Copy of Register (등기부 등본 (유효사항)) must state an address that is physically located in the Republic of Korea. 3. 주 계약자가 모기업이 있는 경우, 투찰업체는 한국 대법원에서 인증 발급하는 모기업의 등본 (등기부 등본 (유효 사항))을 제출하여야 한다. 주 계약자가 한국 계약자로 자격요건을 갖추기 위해서는 모기업의 등본 상 네 번째 단 [등기부 등본 (유효 사항)]에서 반드시 물리적으로 대한민국에 위치한 주소 임을 명시해야 한다. To summarize the requirements stated above: 위에서 언급 한 요구 사항을 요약하면 : An offeror that does not have a "Parent" will submit 2 documents to establish that the offeror is a Korean Contractor: 1) Offeror's Certified Copy of Register, and 2) Offeror's Stock Change Certificate. "모기업"이 없는 투찰업체는 한국 기업 계약자임을 증빙할 수 있는 다음 2가지 서류를 제출한다: 1) 투찰 업체의 인증 등본 2) 투찰 업체의 주식 변경 증명서. An offeror that does have a "Parent" will submit 3 documents to establish that the offeror is a Korean Contractor: 1) Offeror's Certified Copy of Register, 2) Offeror's Stock Change Certificate, and 3) Parent's Certified Copy of Register.
